Terms and Conditions of Surf Travel Lanka LLC

1. Acceptance of Terms
By booking a stay or activity with Marshmellow Surf Company® and Marshmellow Surf Indonesia®, you acknowledge and agree to these terms and conditions. Please review them thoroughly prior to making a reservation.

2. Booking and Payments
A 50% deposit is required to secure all reservations for stays in Lombok and Sri Lanka. The
balance is due per the timeline stated in your booking confirmation.

Not included in your booking:
● Flights
● Transport from airport or port
● Travel insurance
● Baggage fees
● Dinners
● Extra excursions not included in your original package

3.Reservation Agreement
By reserving, the lead guest agrees on behalf of all included parties that:

● They are at least 18 years of age
● They are financially responsible for the full cost of the booking
● They have reviewed and accepted these terms
● They consent to our use of personal information as per our Privacy Policy
● Our minimum stay is 3 nights
● You are responsible for ensuring all booking details are accurate before confirmation

4. Cancellation Policy
We understand that life can be unpredictable, so we’ve designed our cancellation policy to be fair and transparent. By booking your spot at our surf camp, you agree to the terms outlined below:

Cancellations by the Customer:
•⁠  ⁠30+ days before the check-in date: You are eligible for a full refund minus a 10% administrative processing fee.
•⁠  15 to 29 days before the start date: You will receive a 50% refund of the total booking amount.
•⁠  ⁠14 days or less before the start date: Unfortunately, we cannot offer a refund, and the full booking amount will be forfeited.
•⁠  ⁠No Show or Early Departure: No refund or credit will be issued if you fail to show up for the camp or leave before the scheduled end of your camp.

Cancellations or Modifications by Us:
•⁠  ⁠If we need to cancel or modify the camp for any other reason, we will provide you with the option to reschedule or receive a full refund.

Booking Modifications:
•⁠  ⁠If you wish to change the dates or package of your reservation, please inform us at least 14 days before the start date of your camp. We will make every effort to accommodate changes, depending on availability.

Refund Process:
•⁠  ⁠All refunds will be processed within 7-10 business days after approval.

Additional Notes:
•⁠  ⁠No refunds will be granted for changes in your personal circumstances or if you simply change your mind about attending.
•⁠  ⁠If your visa or travel arrangements are delayed, we cannot offer any refunds due to such issues.
•⁠  ⁠In the event of any cancellations, we will keep you updated and offer the best solutions to ensure you are satisfied with the outcome.

5. Changes by Us
We may occasionally need to make changes to the scheduled itineraries or accommodations due to unforeseen circumstances. We will inform you as early as possible and provide suitable alternatives.

6.Check-In & Check-Out Policies
Check-In Day:
● No surfing, breakfast, or lunch
● Free access to: Gym, Yoga, Ice Bath, and Surf Skate (if scheduled)

Check-Out Day:
● Breakfast and morning yoga only
● No surfing or lunch

7. Your Responsibilities
● Ensure you're fit and healthy for all booked activities
● Follow safety instructions and behavior guidelines
● You are responsible for any injuries, illnesses, or losses not caused by our negligence

8. Insurance
All guests must have valid travel insurance covering:

● Water sports (including surfing)
● Medical emergencies
● Cancellations
● Lost/damaged baggage or equipment

9. Holiday Policy
We observe certain national and religious holidays, and some services may be affected or limited during these times.

National Holidays: on New Year's Day (January 1st), surfing lesson will be scheduled in the afternoon.
Eid al-Fitr (End of Ramadam: we will be closed for three days, which falls on March 19, 20, and 21, 2026.

10. Liability and Risk Acceptance
1. General Disclaimer :Marshmellow Surf & Wellness Camp accepts no liability for injuries, death, accidents, or
incidents resulting from surfing, water-based activities, or general stay. Surfing carries
inherent risks which you voluntarily accept by participating.

2. Property & Equipment: We are not liable for lost or damaged property (e.g., surfboards, electronics). Guests
must treat all camp equipment and vehicles with care. You may be charged for any damage due to neglect or intentional misuse.

3. Fitness to Participate:
By booking, you confirm that you:
○ Are physically fit to swim and surf
○ Will not be under the influence of alcohol/drugs during activities
○ Have no condition or injury that could affect your safety
○ Are not pregnant or breastfeeding
○ Have disclosed relevant medical history

4. Medical Responsibility: Disclose any medical conditions or allergies prior to arrival. We may refuse participation
if your condition poses a risk to you or others.

11. Loss and Damages
1. Personal Items: We are not responsible for personal items lost, damaged, or stolen during your stay.
2. Room Damages: Guests will be charged full cost for damaged or missing property in rooms due to neglect or misuse.
3. Surfboards & Gear: We are not liable for lost or damaged surfboards or luggage. Private insurance is recommended.
4. Use of Our Property: Guests must respect our vehicles, boards, and spaces. You are financially liable for
damages caused through careless or intentional behavior.

12. Transportation Services
We assist with cars, motorbikes, and scooter rental but we are not the provider. We are not liable for:

● Vehicle quality or safety
● Accidents or injuries
● Traffic fines or damages

Always inspect the vehicle before renting. Insurance is rarely included, so we recommend your
travel insurance covers vehicle rental.o any third parties without your consent.

13. Excursions & Third-Party Activities
Any excursions or tours booked through outside operators are not covered by our terms. Your
agreement is directly with the provider. We assume no liability for their services, actions, or any
incidents.

14. Surf Policy and Conditions
1. Surf Spot Decisions: Our surf instructors will assign you to suitable groups and select the best surf spots based on conditions and safety.
2. Poor Conditions: While we aim to find the best surf daily, sometimes conditions may be poor or inconsistent. This may lead to all levels surfing together or even canceled sessions.
These circumstances are beyond our control and are not grounds for refunds.
3. Line-Up Behavior: Guests must remain close to instructors and follow surf etiquette. Unsafe or disrespectful behavior may result in exclusion from sessions.

15. Travel Documents & Health Requirements
● You are responsible for meeting all passport, visa, and entry requirements
● Confirm all vaccination and health documentation required by the destination country
● If you have medical conditions or disabilities that may affect your trip, notify us at the
time of booking. Failure to do so may result in refusal or cancellation without refund.2. Room Damages: Guests will be charged full cost for damaged or missing property in rooms due to neglect or misuse.

16. Events Beyond Our Control (Force Majeure)
We are not liable for changes, cancellations, or damages caused by unforeseen events beyond
our control. These may include:

● Natural disasters (e.g., earthquakes, floods, volcanoes)
● Wars, riots, or terrorism
● Epidemics, pandemics, or health emergencies
● Political unrest or closed airports
● Weather or oceanic conditions that disrupt activities. Surf Spot Decisions: Our surf instructors will assign you to suitable groups and select the best surf spots based on conditions and safety.

17. Responsibilities and Conduct
Marshmellow Surf & Wellness Camp will not issue refunds or accept liability in these cases:

● When the guest’s actions result in disrupted services
● When services fail due to third-party negligence or unforeseen events
● When guests behave irresponsibly or fail to follow safety instructions
● When incidents occur before/after scheduled course times

Guests must follow camp rules and staff directions. Irresponsible behavior may result in removal from activities without refund.

18. Privacy Policy
We are committed to protecting your privacy. Your personal information will be used solely for the purpose of processing your booking and will not be disclosed to any third parties without your consent.to any third parties without your consent.
